The New Jersey Bureau of Securities rescinded, without prejudice, its June 2023 summary penalty and cease-and-desist order against Coinbase on 30 October 2026. The order had stopped New Jersey customers from staking new crypto through Coinbase. Coinbase made the rescission public on 2 November and says staking will return for New Jersey users, but has not given a date.

The rescission was made without a ruling on the merits of the 2023 order, and the bureau kept the right to take future enforcement action against Coinbase. The 2023 order had included a $5 million civil penalty; neither the rescission nor Coinbase's statements mention any payment. Coinbase's quarterly report says the regulator told it on 29 October that it intended to rescind the order. This was an administrative order, not a court case, although Coinbase staff describe it as a dropped lawsuit.

As of 3 November, Coinbase's staking eligibility page still groups New Jersey with California, Maryland and Wisconsin, where no new principal can be staked, current stakers keep earning rewards that do not compound, and unstaked funds cannot be restaked. Washington has also issued a notice, but its residents can still stake. Staking is fully available in all other states, according to the same page.

Coinbase says New Jersey users missed more than $15 million in staking rewards while the order was in place. Alabama, Illinois, Kentucky, South Carolina and Vermont dropped their staking actions against Coinbase in 2025, according to its quarterly report.

“The Coinbase Order is rescinded, without prejudice.”
